By accessing or using LingoScan ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Use License

We grant you a personal, non-transferable, non-exclusive license to use the Service for language learning purposes, subject to these Terms.

You may:

  • Analyze text, images, PDF files, audio files, and video files for vocabulary extraction and language learning
  • Create, edit, and organize vocabulary words and flashcards
  • Use real-time speech-to-text transcription for pronunciation practice
  • Generate text-to-speech audio for pronunciation learning
  • Save and manage your vocabulary across multiple languages
  • Access your content from multiple devices
  • Export your saved words and flashcards for personal use

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to access other users' content without permission
  • Reverse engineer or attempt to extract the source code
  • Use automated systems or bots to access the Service
  • Circumvent subscription limits or attempt to bypass premium features
  • Upload content that violates intellectual property rights or applicable laws
  • Interfere with or disrupt the Service or servers connected to the Service

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to use this Service
  • You are responsible for all activities that occur under your account

3.2 Account Termination

  • We may suspend or terminate accounts that violate these Terms
  • Accounts inactive for 12 months or more may be deleted
  • Upon termination, your right to use the Service will immediately cease

You retain ownership of all content you create, including saved words, flashcards, and uploaded files. By using our Service, you grant us a limited license to store and display your content solely for the purpose of providing the Service to you.

4.2 Prohibited Content

You agree not to upload, create, or share content that:

  • Infringes on any copyright, trademark, or other intellectual property rights
  • Contains illegal, harmful, threatening, abusive, or discriminatory material
  • Includes personal information of minors without proper consent
  • Contains malware, viruses, or other harmful code
  • Violates any applicable laws or regulations
  • Is inappropriate for an educational or language learning environment
  • Contains sensitive personal information of others without authorization

4.3 Copyright Compliance

  • You must have the right to use any content you upload
  • Educational fair use must comply with applicable copyright laws
  • We will respond to valid DMCA takedown notices
  • Repeated copyright violations may result in account termination

5. Privacy and Data Protection

6. Service Availability

  • We strive to maintain Service availability but do not guarantee uninterrupted access
  • We may modify or discontinue features with reasonable notice
  • We are not responsible for issues caused by internet connectivity or device problems
  • We may perform scheduled maintenance that may temporarily interrupt service
  • We reserve the right to limit or restrict access to the Service for any reason

7. Subscription and Payment Terms

  • Premium subscriptions are billed according to the plan you select
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through manage subscription in premium page
  • We reserve the right to change subscription prices
  • Subscription limits and features are subject to change
  • Payment processing is handled securely by Stripe

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICE.

You agree to indemnify and hold harmless LingoScan, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operates, without regard to conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Service or via email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
